These terms and conditions concern jewellery sales, bespoke work and gift certificates provided by Renate Bauer, Schmuckwerkstätte Renate Bauer, Pfarrplatz 2, 4020 Linz, Austria.
1. Enquiries and contracts
This website presents a selection of my work. It has no shopping cart or online payment facility. Displaying a piece or submitting an enquiry does not in itself create a purchase contract.
A contract is formed when we agree on the piece or service, its price and the other order conditions, and the offer and acceptance match. For bespoke work, we agree in particular on materials, dimensions, design and completion. These terms apply if they were made available and agreed before the contract was concluded. Individual agreements take priority; mandatory statutory rights remain unaffected.
2. Prices and payment
We agree on the total price, including statutory VAT and any delivery charges, before concluding the contract. Payment is possible in cash or by bank transfer. A deposit of 50 percent of the order total is payable when the order is placed, unless we agree otherwise. The due date for the balance is agreed when ordering. The piece remains the property of Renate Bauer until fully paid.
3. Collection and delivery
Jewellery and gift certificates can be collected from the atelier. If delivery is agreed, the address, charges and delivery date are settled before the contract is concluded. For bespoke work, the agreed completion time depends on the scope of the work. Statutory rules on the transfer of risk apply to deliveries to consumers.
4. Statutory right of withdrawal
Consumer contracts covered by the Austrian Distance and Off-Premises Contracts Act (FAGG) generally carry a right to withdraw within 14 days without giving a reason. This may also apply to contracts concluded by email or telephone. For goods, the period begins when you or a person you nominate, other than the carrier, receives them; for separate deliveries under a single order, it begins on receipt of the last item. For services, it begins when the contract is concluded.

After withdrawing, return the goods to the above address within a further 14 days. Sending them within that period is sufficient. You bear the direct return costs if you were informed of this before the contract was concluded. Original packaging is not a condition for exercising your statutory withdrawal right. You are responsible for diminished value only where the statutory conditions are met, in particular where handling went beyond what was necessary to establish the goods’ nature, characteristics and functioning.
We refund the payments received, including the cost of our least expensive offered standard delivery, within 14 days of receiving your withdrawal statement. We use the original payment method unless we expressly agree otherwise at no cost to you. For goods, we may withhold the refund until we receive the goods or evidence of their return, whichever happens first. This does not apply if we have offered to collect the goods. You are not required to accept a gift certificate as a refund.
Goods made to your specifications or clearly personalised are generally excluded from the right of withdrawal under section 18(1)(3) FAGG. Statutory exceptions to this exclusion remain unaffected. Describing an already finished piece as “one of a kind” does not by itself exclude withdrawal. We inform you of any applicable exclusion before the contract is concluded.
For purchases made at the atelier, there is no general statutory right to withdraw merely because you change your mind. A voluntary exchange may be agreed. Statutory warranty rights remain unaffected.

6. Statutory warranty and liability
Statutory warranty and liability provisions apply. For consumer purchases of goods, the warranty period is generally two years from delivery. A defect appearing within the first year is generally presumed to have existed at delivery, unless this is incompatible with the nature of the goods or the defect. Depending on the statutory conditions, remedies include repair or replacement, a price reduction or termination of the contract.
Please contact us if a defect occurs. For consumer purchases, immediate notification, original packaging or presentation of the original till receipt alone is not a condition for statutory warranty claims. You may prove the purchase by other suitable means.
7. Gift certificates
Gift certificates are available at the atelier; their value and any delivery are agreed individually. They can be used for jewellery and bespoke work. Any balance remains available after partial redemption. Certificates are transferable. Cash redemption is not provided for, subject to statutory claims. Unless a valid expiry period was agreed, the general statutory limitation period of 30 years applies. Statutory withdrawal and refund rights remain unaffected.
8. Applicable law and contact
Austrian law applies. Consumers retain the protection of applicable mandatory provisions of the country of their habitual residence. Jurisdiction is determined by law.
